Las compañías multadas son Asefa, con 27,7 millones de euros; Swiss RE, con 22,6 millones de euros; Mapfre, con 21,6 millones de euros; Scor, con 18,5 millones de euros; Munchener, con 15,8 millones de euros; y Caja de Seguros Reunidos (Caser), con 14,2 millones de euros.

Esta multa se sitúa en el primer lugar en el ranking de las sanciones en materia de competencia por delante de una de 57 millones de euros impuesta a Astel y Telefónica en 2004 y la tercera, de 38,7 millones, impuesta a Iberdrola en 2007.

La CNC concluyó que las compañías aseguradoras alcanzaron un acuerdo de precios mínimos con el objetivo de que fuese aplicado no sólo por ellas, sino por todo el mercado del seguro decenal.

Para ello, las compañías se comprometían a incorporar el pacto de precios mínimos a las guías de tarficación que se anexan a los contratos de reaseguro como contenido de obligado cumplimiento por las aseguradoras.

El resultado de esta maniobra fue la total homogeneidad en las primas propuestas por las distintas aseguradoras presentes en el mercado del seguro decenal en España y la eliminación de la competencia, explica la CNC.

El cártel de precios mínimos se mantuvo vigente desde 2002 a 2007 y durante estos años las empresas participantes vigilaron que el acuerdo de precios mínimos fuese respetado por ellas y el resto de compañías del sector.

EVIDENTES ACTOS DE RETORSION Y BOICOT.

‘Existe evidencia de que determinados miembros del cártel realizaron actos de retorsión y de boicot frente a las empresas que se negaban a sustraerse a la disciplina del cártel de precios mínimos, llegando incluso a conseguir romper operaciones comerciales cerradas’, concluye la CNC.

Cuando se detectaban incumplimientos, las compañías denunciaban la situación a los restantes miembros del cártel, que de forma coordinada ejercían presión sobre la aseguradora, la entidad financiera, el corredor de seguros o la compañía reaseguradora que había aceptado asegurar las pólizas a precios inferiores.

La Ley de Ordenación de la Edificación introdujo en 2002 la obligación para los promotores de edificios nuevos destinados a viviendas de contratar un seguro de daños materiales a diez años que garantiza los daños causados en el edificio de origen estructural.

Ante el crecimiento del sector de la construcción, y para evitar la caída del precio del seguro decenal, las compañías multadas se reunieron con el objetivo de alcanzar un acuerdo de precios mínimos, que se materializó en un documento de 5 de diciembre de 2001.

El Real Automóvil Club de España (RACE) y la red de talleres Bosch Car Service presentaron hoy un informe en el que se analiza la situación en España sobre iluminación y visibilidad para reducir este riesgo que, según los datos referidos al año 2008 para ciudad y carretera de la Dirección General de Tráfico (DGT), provoca el 42 por ciento de los accidentes mortales en España.

   En el caso de considerar los factores climatológicos adversos, los datos estadísticos muestran como el 18,4 por ciento de los accidentes mortales se producen bajo condiciones atmosféricas tales como niebla, lluvia, granizo y nieve. Por este motivo, en el informe se ha preguntado a más de 3.500 usuarios sobre circulación invernal y, además, se han analizado los resultados de las inspecciones ITV sobre alumbrado y visibilidad.

   Con el objetivo de conocer un poco mejor el conocimiento de los usuarios y el estado de los vehículos se ha destacado, sobre el mantenimiento, cómo el 65% por ciento de los encuestados cambia las lámparas sólo cuando se funden, “lo que significa que no existe un mantenimiento periódico ni preventivo”, explica el informe. Respecto al sistema de alumbrado que dispone cada usuario encuestado, indica que el 68 por ciento dispone de lámparas halógenas, y sólo un 19 por ciento tiene Xenon.

   Por otro lado, la percepción del usuario sobre iluminación y Seguridad Vial señala que el 81 por ciento de los encuestados fue alguna vez deslumbrado completamente, y el 19 por ciento ha circulado con los faros fundidos sin saberlo. En cuanto a la visibilidad, el 37 por ciento ha circulado con unas escobillas en mal estado.

   En base a estos resultados, “en los que se demuestra que falta mejorar la formación del usuario”, según el informe, el RACE y la Red de Talleres Bosch Car Service han puesto en marcha una campaña para mejorar el conocimiento del conductor sobre iluminación y visibilidad, sobre todo en esta época de menor luminosidad y climatología adversa.

   Para ello, se distribuirán en los centros de RACE y de Bosch 50.000 folletos divulgativos con consejos, así como carteles distribuidos por los más de 600 talleres de su red, aprovechando los miles de conductores que pasan por estas instalaciones durante esta época del año.

CLIP DIVISA ACUMULADOR IMPORTADOR BANKINTER

Hay numerosos clientes afectados por el productor Clip Bankinter, ya que la gran mayoria no fueron informados de ese producto debidamente, y han tenido muchos problemas, motivando un gran numero de reclamaciones y procedimientos judiciales.

Reproducimos el contenido de una Sentencia Audiencia Provincial de Alava, que da la razón al cliente:

La nulidad del contrato “CLIP DIVISA ACUMULADOR IMPORTADOR” por sus cláusulas oscuras y la falta de información conlleva la devolución de los perjuicios generados por el mismo

“… Descendiendo al caso concreto procede examinar el contrato pactado que lleva por título “CLIP DIVISA ACUMULADOR IMPORTADOR”. En el primer párrafo se dice que es un producto de cobertura global que permite al cliente contar con un cambio mínimo asegurado para la compra de la divisa, a la vez que se puede beneficiar de la depreciación de la divisa hasta un cambio máximo determinado por la barrera. En el tercero que el cambio de compra de la divisa en la fecha de la expiración vendrá determinado por los diversos Cambio de Acumulación Semanal, fijados durante la duración del producto, tal y como se describe mas adelante. Ofrece como ventajas que el cliente cuenta con un cambio mínimo de compra asegurado (coste máximo de la compra), el cliente puede beneficiarse de los movimientos de depreciación de la divisa. Como inconvenientes: Los movimientos de depreciación de la divisa están limitados a que se alcance el nivel de barrera. Si la barrera es alcanzada, el cliente acumulará la proporción correspondiente de la divisa al cambio de compra asegurado, convirtiéndose en este momento en un seguro de cambio. En cuanto a los datos de la operación el mismo contrato describe el cambio de referencia, cambio oficial de la divisa publicado los días hábiles por el Banco Central Europeo; Fechas de observación, todos los viernes, el cambio de acumulación semanal dependerá de si el cambio de referencia publicado en la fecha de observación ha sido igual, inferior o superior a la barrera; si el cambio de referencia publicado en la fecha de observación ha sido inferior a la Barrera, el Cambio de Acumulación Semanal será el Cambio máximo entre el Cambio de compra asegurado y el cambio de referencia en la fecha de observación. Si el cambio de referencia publicado en la fecha de observación ha sido igual o superior a la barrera, el cambio de acumulación semanal será el cambio de compra asegurado. La barrera se fija en 1,339 (documento anexo nº 3), el cambio oficial determinado en el día que se firma se publica a las 14.15 horas por el Banco Central Europeo, por este motivo, y con el conocimiento del cliente se rellenaron las características del producto de la segunda hoja de este documento con posterioridad, lo mismo que el importe de la compra que ascendía a un millón de dólares, habiendo quedado acreditado que el Sr. Oscar como administrador de la entidad actora conocía estas características, el director de la sucursal así lo explica en el acto de juicio, resultando sus explicaciones en este sentido convincentes.
